Have You Been Involved In An Automobile Accident
With A Jimmy Johns' Delivery Driver?
It is not a good idea to describe your delivery as "freaky fast" if you
have safety as a concern. I don't believe that any Jimmy Johns
does.
In their advertising, with a lot of emphasis in the radio spots, Jimmy Johns glorifies speed and the speed of delivery.
Don't you think that a corporation would learn from the corporate history of another company, oh, maybe, like Domino's Pizza?
30-minute guarantee

Starting in 1973, Domino's Pizza had a guarantee that customers would
receive their pizzas within 30 minutes of placing an order, or they
would receive the pizzas free. The guarantee was reduced to $3 off in
the mid 1980s. In 1992, the company settled a lawsuit brought by the
family of an Indiana woman who had been killed by a Domino's delivery
driver, paying the family $2.8 million. In 1993, Domino's settled
another lawsuit, this one brought by a woman who was injured when a
Domino's delivery driver ran a red light and collided with her vehicle.
The woman was paid nearly $80 million. The guarantee was dropped that
same year because of the "public perception of reckless driving and
irresponsibility", according to Monaghan.[46]
In December 2007, Domino's introduced a new slogan, "You Got 30
Minutes", alluding to the earlier pledge but stopping short of promising
delivery in a half hour.[47]

Whenever a company talks about how fast they deliver, it's always
increases the public perception that delivery drivers from any company
are unsafe. Jimmy Johns might as well put a huge sign on their
corporate offices that says, "SUE US! WE'VE MADE IT EASY FOR
YOU!!!"
When you also add to the mix companies like the Jimmy Johns in Clifton,
who have full knowledge that vehicles are hitting the road in unsafe
condition, you can practically expect accidents to occur.
IF YOU ARE INVOLVED IN AN ACCIDENT:
Do everything you would do in a normal accident. Call the police,
swap information with the other driver, and make sure the police
include in the police report the fact that the driver was working for Jimmy Johns when the accident occured.
Also, be sure to ask the driver if he has the commercial insurance for
the vehicle, or the company provided commercial insurance. They won't have that information. As far as I am aware, Jimmy Johns in Clifton doesn't carry any.
If the driver looks under the influence of any substances, ask the
police to perform a sobriety test (remember, it is illegal in Ohio to
be under the influence of any drug while operating a motor wehicle),
God forbid you should have any injuries, because there is a chance the
driver's personal insurance won't cover him if they are working
delivery.
